NovaFrontierDynamics (“we,” “us,” or “our”) is committed to protecting your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and applicable Spanish data protection legislation, including the Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD).

Data We Collect:
We collect personal data that you voluntarily provide through our contact forms, email communications, and service agreements. This includes: full name, email address, phone number, company name, project descriptions, and billing information necessary to execute our digital transformation services.

Purpose of Processing:
Your personal data is processed exclusively for the following purposes: (a) responding to your inquiries and establishing communication channels; (b) delivering the digital transformation services you have requested; (c) managing contractual obligations and billing; (d) complying with legal obligations under Spanish and EU law; and (e) improving our service delivery based on aggregated, anonymized usage patterns.

Legal Basis for Processing:
We process your data based on: (a) the performance of a contract (Article 6(1)(b) GDPR) for service delivery; (b) your explicit consent (Article 6(1)(a) GDPR) for marketing communications; (c) compliance with legal obligations (Article 6(1)(c) GDPR) for tax and accounting requirements; and (d) our legitimate interest (Article 6(1)(f) GDPR) in improving our services and ensuring network security.

Data Retention:
We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected. Contract-related data is retained for a maximum of 6 years after the conclusion of the business relationship, in compliance with Spanish commercial and tax legislation. Inquiry data is deleted within 12 months if no contractual relationship is established.

Your Rights:
Under the GDPR, you have the following rights regarding your personal data: (a) Right of Access (Article 15) — obtain confirmation of whether we process your data and receive a copy; (b) Right to Rectification (Article 16) — correct inaccurate or incomplete data; (c) Right to Erasure (Article 17) — request deletion of your data where no legal retention obligation exists; (d) Right to Restriction (Article 18) — limit the processing of your data in certain circumstances; (e) Right to Data Portability (Article 20) — receive your data in a structured, machine-readable format; (f) Right to Object (Article 21) — object to processing based on legitimate interests. Data Security:
NovaFrontierDynamics implements appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit and at rest, access controls, regular security assessments, and employee training on data protection protocols.

International Data Transfers:
We do not transfer your personal data outside the European Economic Area (EEA) unless adequate safeguards are in place, such as Standard Contractual Clauses approved by the European Commission or adequacy decisions under Article 45 GDPR.

Right to Lodge a Complaint:
If you believe that our processing of your personal data violates the GDPR, you have the right to lodge a complaint with the Spanish Data Protection Authority (Agencia Española de Protección de Datos — AEPD) at www.aepd.es.

// Refund Policy

General Refund Terms:
At NovaFrontierDynamics, we are committed to delivering high-quality digital transformation services. Given the nature of our work — which involves custom software development, system architecture, and infrastructure migration — refunds are evaluated on a case-by-case basis according to project milestones and deliverables achieved.

Pre-Project Phase:
If you cancel a project before any work has commenced, you are entitled to a full refund of any advance payments made, minus any non-recoverable administrative costs incurred during the scoping phase (not to exceed 10% of the total advance payment).

During Project Execution:
Refunds during active project phases are calculated based on completed and approved milestones. For work that has been completed and approved by the client, no refund is applicable. For work in progress at the time of cancellation, a prorated refund will be issued based on the percentage of completion relative to the current phase budget.

Post-Delivery Phase:
Once a deliverable has been delivered and accepted by the client, refunds for that deliverable are not available. However, if a delivered product demonstrably fails to meet the agreed-upon specifications documented in the project scope, we will, at our discretion, either (a) rectify the issue at no additional cost, or (b) issue a partial refund proportional to the scope of the deficiency.

Subscription and Retainer Services:
For ongoing retainer agreements or monthly service subscriptions, cancellation requires a minimum 30-day written notice. Refunds for the current billing period are not available once work has commenced for that period. Unused portions of prepaid periods beyond the notice window will be refunded on a prorated basis.

Refund Process:
To request a refund, contact us at [email protected] with your project identifier and the reason for your request. We will acknowledge receipt within 2 business days and provide a resolution within 15 business days. Approved refunds will be processed using the original payment method.

Governing Law:
This Refund Policy is governed by Spanish law. Any disputes arising from refund requests shall be subject to the jurisdiction of the courts of Gipuzkoa, España.

// Terms of Service

Acceptance of Terms:
By accessing or using the services provided by NovaFrontierDynamics (“we,” “us,” or “our”), located at Ebda. Tenientes Txurruka 9, Mutriku, Gipuzkoa, España, you (“Client” or “you”) agree to be bound by these Terms of Service. If you do not agree to these terms, you must not engage our services.

Scope of Services:
NovaFrontierDynamics provides digital transformation services including, but not limited to: legacy system modernization, cloud migration architecture, process automation, data infrastructure design, API integration, DevOps pipeline setup, cybersecurity implementation, and digital strategy consulting. The specific scope of services for each engagement is defined in a mutually agreed-upon Statement of Work (SOW) or project proposal.

Project Engagement:
Each project engagement begins with a discovery phase during which we assess your existing infrastructure and define project requirements. A detailed proposal and timeline will be provided before any work commences. Work begins only upon written approval of the proposal and receipt of the agreed-upon advance payment.

Payment Terms:
Unless otherwise specified in the SOW, payment terms are: (a) 50% advance payment upon project approval; (b) 25% at the midpoint milestone; (c) 25% upon final delivery and acceptance. All payments are due within 15 days of invoice date. Late payments may incur a statutory interest rate in accordance with Spanish commercial law (Ley 3/2004).

Intellectual Property:
Upon full payment, all intellectual property rights for custom-developed code, architectures, and deliverables specific to your project are transferred to you. NovaFrontierDynamics retains the right to use general methodologies, frameworks, and non-proprietary tools developed or refined during the engagement for future projects.

Confidentiality:
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This includes technical architectures, business processes, data structures, and strategic plans. This obligation survives the termination of the engagement for a period of 24 months.

Limitation of Liability:
NovaFrontierDynamics shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total aggregate liability for any claim arising from an engagement shall not exceed the total fees paid by the Client for that specific engagement during the 12 months preceding the claim.

Warranty:
We warrant that all deliverables will conform to the specifications defined in the approved SOW for a period of 90 days following final delivery. During this warranty period, we will correct any defects at no additional cost. This warranty does not cover issues arising from modifications made by the Client or third parties after delivery.

Termination:
Either party may terminate an engagement with 30 days written notice. In the event of termination, the Client is responsible for payment of all work completed up to the termination date. NovaFrontierDynamics reserves the right to terminate immediately if the Client breaches material terms of this agreement or fails to make payments within 30 days of the due date.

Governing Law & Jurisdiction:
These Terms of Service are governed by the laws of España. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Gipuzkoa, España.
